Mike Smith was born and raised in East Texas. He started his career as a trial attorney over 35 years ago as a prosecutor in the office of legendary Dallas County District Attorney, Henry Wade. On his return to East Texas, he served as the Criminal District Attorney of Upshur County. For the last 28 years, he has been in private trial practice representing plaintiffs and defendants in serious and complex litigation.
The subject matter of Mike's cases has been extensively varied including confined space litigation involving catastrophic injury; injury resulting from severe electrical shock, chemical, and asbestos exposure; air disaster litigation; damage to dairy cattle resulting from defective feed; damages for violation of right of free speech; wrongful termination of employment and slander; and complex family law litigation.
Throughout his career, many of Mike's cases have involved claims of product liability and negligence. One such case was the landmark case of Burk Royalty Co. vs Walls, 616 SW2d 911 (Tex. 1981) which redefined gross negligence in the state of Texas. In recent years, Mike has been involved in toxic tort litigation throughout the United States to include Texas, Arkansas, Oklahoma, and California.
